1. GENERAL TERMS AND CONDITIONS OF USE OF OUR SERVICES
1.1 Definitions - methodology
“HOLISTIC BLOOMING” yoga programs are a method of therapeutic physical and mental
exercise, in pursuit of healthy growth and self-improvement on a basis of a healthy physical and mental condition and a balanced diet and daily life of the individual. Our services are the result of a combination of Thaleia Ioanna Panopoulou's knowledge, experience, and inspiration, our programs remain constantly evolving based on the best yoga, breathing, and meditation techniques and wellness approaches. The words program, programs, services or service package, where mentioned have identical meaning and mean the services provided by HOLISTIC BLOOMING, inspired and designed exclusively by Thaleia Ioanna Panopoulou.
1.2 Acceptance of the Terms
Anyone who makes use of the services of HOLISTIC BLOOMING, by purchasing a package of our services (e.g. online classes, courses, workshops, retreats etc) is presumed to have accepted the following terms which form the basis of the contract for the purchase of our services and their use by you, the customer/user of our HOLISTIC BLOOMING website.
1.3 Who we address to as customers
A prerequisite for your use of our services and your financial transaction with HOLISTIC
BLOOMING is that you are at least 18 years old, that you have full legal capacity, and that you are a consumer as the meaning of consumer is defined according to the applicable Greek and European Union Laws, among other things, you must be a person (not legal entities) who is dealing with us for reasons that do not fall within the scope of your professional or business activity. By way of exception and only upon specific written agreement, HOLISTIC BLOOMING services may be made available to companies in the context of group - corporate benefits for their employees. The use of the services of HOLISTIC BLOOMING for commercial purposes of any kind, as well as any public display of the content, in public or private places, without the prior written consent of the creator of the programs Thaleia Ioanna Panopoulou is expressly prohibited.
1.4 Copyright
Users of our website and clients of HOLISTIC BLOOMING are informed about the context of our special programs after expressing their interest in writing or by booking services. All our programs and all their content have been created by Thaleia Ioanna Panopoulou, they are original, products of her own inspiration and any copying, recording with any audiovisual medium, reproduction, presentation to third parties without the author's permission is prohibited. We grant to our clients a non-exclusive and non-transferable right to use this content in non-commercial form within the scope of the contractual provisions and these terms. The right of use will expire when your access to the respective service is no longer active.
1.5 Duty of confidentiality and good faith
As users of our website or customers of HOLISTIC BLOOMING, by accepting the terms of this agreement, you responsibly declare that you undertake the obligation: To maintain absolute confidentiality regarding a) any information, data, documents, data relating to the protection of the programs mentioned in the above clause 1.4 and those that may be added in the future by the creator during the use of the website and the services provided. The obligation of confidentiality assumed by the users shall apply in any case. Not to proceed in any way to transfer, make available, send, mail, publish, disclose to any third party the confidential content without the authorization of the author. Maintain complete confidentiality vis-à-vis any third party and generally refrain from any form of processing of the information disclosed to you which may infringe the rights of the author or which is contrary to the purposes of the author or irrelevant to the context of use of the services. Finally, you declare and accept that the obligations in this declaration shall be binding on you both during the period of use of the services and after the termination of the services without limitation.
1.6 Services and pricing
The range and duration of access to the content and services offered by Holistic Blooming depend on the package of services and the training plan you purchase. In order to use some of the services to their full extent, specific equipment and training tools may be required, the provision of which is not part of the HOLISTIC BLOOMING services, these you must already have or obtain them at your own expense. With regard to our programs please consult our website for information on the respective current pricing models, offers and services included. All prices quoted include applicable VAT unless specifically stated otherwise.
1.7 Our health is our most important asset
Your use of HOLISTIC BLOOMING services is at your own risk. In any case, in order to use our services you must be in good general health. If you know you have a medical condition, we advise you to seek urgent medical advice before you start practicing yoga or following any of our programs. Your use of our services implies that you are aware that you do not have a medical condition or, if you do have a medical condition and you are aware of it, you are already receiving appropriate treatment and are under medical supervision, you have consulted your doctor and your condition allows you to exercise, and you choose and follow our programs in full knowledge of these terms. Pregnant and nursing mothers, are not permitted to follow our programs, there are special yoga programs for pregnants and nursing mothers, not offered yet by ΗOLLISTIC BLOOMING. Persons with permanent or temporary disabilities, persons with injuries or general chronic or temporary health problems are not recommended to do the full exercises of the programs, except after special consultation with us or should follow specially designed programs that may be offered after consultation with us. If you are in doubt about your health (if you are experiencing significant pain, discomfort, shortness of breath, nausea or dizziness, etc.) consult your doctor before starting or continuing to follow our programs. By purchasing any of our service packages you simultaneously waive any claim either against HOLISTIC BLOOMING or against Thaleia Panopoulou individually or any other trainers, instructors and generally our representatives and employees from any injury to you or other harm of any kind from the use of our services, as your use of them is done with full knowledge of these terms and conditions and with full awareness of your health condition and your own physical and mental peculiarities, with your own decision and by free will.
1.8 We are not a substitute for medical treatment and advice.
The services and information we offer do not constitute medical care or medical advice, in no way do we substitute for medical science. Our yoga practice and use of our programs are not a substitute for medical examination, diagnosis or treatment.
1.9 Transaction and payment
The transaction for the purchase of a service is concluded with the payment of the fee, which is collected through the payment of a lump sum. In case you have purchased a service remotely through our website, in order to exercise your right of withdrawal (within 14 days) before making any other use of our service, you must send us an email to hello@holisticblooming.com. For this refund we will use the same payment method that you used for the original transaction, unless a different payment method is agreed (in writing).
1.10 Payment methods
Payments are made via interbank money transfer by any accepted electronic payment
method if supported by HOLISTIC BLOOMING or by cash in person (cash/credit card/application (App. e.g. IRIS, Applepay etc.). If we incur costs because a payment is
declined through your fault (e.g. because there are insufficient funds in the account or the credit card limit has already been exhausted), then we have the right to charge you with any additional costs incurred. Where there is a legitimate reason, we reserve the right to refrain from offering certain payment methods and to specify alternative payment methods.
1.11 Efficiency of services - disclaimer of guarantees
We do not represent or warrant that the use of our services will produce the result you
desire. We do not promise specific success, the outcome of a program of our services may be different for each individual who implements it. A good result will depend on factors such as your full and proper use of the program, your mood, physical condition, health, nutrition and a host of other factors that are dependent on you. Your rights as a consumer apply in all cases.
1.12 Liability
When executing exercises you must faithfully follow our instructions or risk injury or damage to your health. To the extent that you use equipment - training tools it is your responsibility to ensure that such equipment - training tools are in good working order and are installed correctly. You must observe and respect all of these terms and conditions, particularly those relating to the safety of your health.
1.13 Consent to the protection of personal data
We use your personal data in accordance with our Privacy Policy (please view GENERAL
TERMS OF USE OF OUR WEBSITE & PRIVACY POLICY) and always for the purposes of
managing bookings and access to the content of the Website available only to customers, sending communications about new programs, services and products available from our Website and sending newsletters. By accepting these terms you also grant your consent for the use of the data you provide us for the above purposes and as set out in οur Privacy Policy.
1.14 Changes to the General Terms and Conditions of Use
We reserve the right to modify and adapt these general terms and conditions with future
effect, i.e. without such changes taking over existing agreements for already purchased
services. In the event that such changes are required due to extraordinary circumstances, customers who have purchased services that may be affected by the changes will be notified by email 15 days prior to their effective date. If they do not object within this period they will be presumed to accept the changes. Otherwise we reserve the right to cancel any pending agreement by refunding the customer the exact price.
1.15 Law-Jurisdiction
Adherence of these terms is governed by Greek law, any dispute arising from the violation of these terms is subject to the exclusive jurisdiction of the Greek courts and in particular the courts of Athens.
